Zoning Hearing Board
The Borough's Zoning Ordinance sets forth various front, side and rear yard requirements, lot sizes, coverage limitations, use regulations, height restrictions and other regulations pertaining to land parcels and structures.
The Borough's Code Enforcement Officer enforces the provisions of the Zoning Ordinance. When it is determined that an individual cannot meet one or more of the zoning regulations, that individual has the right to appeal to the Zoning Hearing Board for a variance and/or special exception to the regulation(s). The fee for this appeal process is $275.
Once the individual has completed the application for the appeal and paid the required fee, a meeting of the Zoning Hearing Board is scheduled to hear the appeal. These meetings are typically held on the third Wednesday of the month in the Conference Room on the second floor of the Borough Hall, 60 W. Emaus Street, Middletown, beginning at 6:30 p.m.
At the meeting, members of the Zoning Hearing Board hear testimony from the individual and other interested parties. The Board has 45 days from the date of the meeting in which to notify the individual of their decision. Call the Code Enforcement Office for information at 902-3077.
